SHORELINE MANAGEMENT PLAN
SCOPE OF WORK
1.0 GENERAL
The work described by these documents is to be performed for Appalachian Power Company (hereforth referenced as the Owner) at the Owner’s Smith Mountain Pumped Storage Project located on the Roanoke River approximately 27 miles upstream of Altavista, Virginia. The Smith Mountain Pumped Storage Project consists of two developments known as the Smith Mountain (Upper) Development and the Leesville (Lower) Development. The term “Contractor” shall mean the responsible entity submitting formal materials and services in accordance with the specifications herein.
2.0 PURPOSE
This document shall be worked in conjunction with the Owner’s GENERAL CONDITIONS, the project drawings, and any other referenced documents. The purpose of this document is to supplement and amend, if necessary, the GENERAL CONDITIONS with site and project specific data and requirements.
3.0 PROJECT TITLE
The specific project for which this document has been prepared will be known as Smith Mountain Pumped Storage Project: Shoreline Management Plan.
4.0 PROJECT DATA
4.1 Location
The Smith Mountain Pumped Storage Project is located on the Roanoke River in the south central region of Virginia. Two developments comprise the Smith Mountain Pumped Storage Project those being the Smith Mountain (Upper) Development located at river mile 314 and the Leesville (Lower) Development located at river mile 296. A location map is provided as part of these documents.
4.2 Description
The Smith Mountain Development consists of a concrete arch dam with integral powerhouse. The upstream reservoir has a surface area of approximately 20,600 acres and approximately 500 miles of shoreline along which are a moderate number of upscale private residences along with a number of public and private recreational sites. The reservoir surface elevation can fluctuate up to 2 ft. during a normal cycle and up to 8 ft. seasonally. The normal maximum operating level for the Smith Mountain Development is elevation 795.0 (National Geodetic Vertical Datum) NGVD. The project boundary for the Smith Mountain Development generally follows contour elevation 800.0 NGVD around the perimeter of the Smith Mountain Reservoir except in those areas defined by survey beyond the referenced contour elevation.
The Leesville Development is the lower development of the Smith Mountain Pumped Storage Project and consists of a concrete gravity dam with integral powerhouse. The upstream reservoir has a surface area of approximately 3,040 acres and approximately 100 miles of shoreline. Development along the Leesville Reservoir is limited as are public and private recreational facilities. The reservoir surface elevation can fluctuate up to 13 ft. during a normal cycle. The normal upper operating level for the Leesville Development is elevation 613.0 NGVD. The project boundary around the Leesville Reservoir generally follows contour elevation 620.0 NGVD except in those areas defined by survey beyond the referenced contour elevation.
Included as part of this document are copies of Exhibit–K drawings from the license for the Smith Mountain Project showing the project boundaries.
5.0 SCOPE OF WORK
The scope of work shall consist of the Contractor providing the labor, materials, supervision and equipment necessary to prepare the Shoreline Management Plan (Plan) for the Smith Mountain Pumped Storage Project. The Contractor shall also provide representation at Consultations with the Owner and/or representatives of the Steering Committee and at public meetings as required by the Owner. The term “Steering Committee” shall mean the collective group of representatives consisting of the Owner, Federal and State agencies, local governments, non-governmental organizations, and others (determined during consultations occurring prior to the selection of the Contractor) to collaboratively work with the Contractor and the Owner to have the work completed and filed with the FERC as outlined in this document. Contractor shall provide a final report summarizing the work and presenting all relevant data. The Contractor shall also provide up to four (4) Draft interim documents for review and comment by the Owner and the Steering Committee during the development of the final Plan.
The work area shall include the reservoirs for the Smith Mountain and Leesville Developments for the Smith Mountain Pumped Storage Project and all properties within and immediately adjacent to the boundary for the subject project. The project boundary for the Smith Mountain Pumped Storage Project essentially follows the 800 ft. contour around the Smith Mountain Development and the 620 ft. contour around the Leesville Development. All contour elevations are National Geodetic Vertical Datum (NGVD). Consideration shall also be given to potential influences on project shoreline development from outside the described work area as appropriate. It should be recognized that the work area is within four counties in the Commonwealth of Virginia, those being Franklin, Bedford, Campbell and Pittsylvania.
The Owner shall file the final Plan, which will include the final report and any agreements among the Owner, Federal and State agencies, local governments, non-governmental organizations, and others represented by the Steering Committee members, with the Federal Energy Regulatory Commission (FERC) for approval. The Contractor shall provide the support necessary to prepare and consummate any associated agreements and to receive approval from the FERC. That support may include consultations with the FERC and providing any additional information required by the FERC in order to obtain final approval of the Plan.
The Plan shall be the planning tool to be followed in the development of the shoreline within the project boundary for the project reservoirs under the conditions of and over the remaining term of the existing license for the Smith Mountain Pumped Storage Project that expires April 2010. The intent is that all future development that falls within the limitations established by the Plan shall be permitted within the requirements of the conditions of the project license but without the need for prior approval by the FERC. However, any activities not falling within the limitations established by the Plan shall require FERC approval. Therefore, the Plan shall establish procedures and guidelines for obtaining approval from the FERC.
The Plan should reflect managing activities along the project shorelines and within the project boundaries under the conditions of the existing license, be flexible to allow for modifications during the remaining term of the existing license, and be adaptable to changes in project operations that may result from the issuance of a new license. There are to be no modifications to the existing operations for the Smith Mountain Pumped Storage Project as part of the plan (e.g. reservoir operating levels). The Plan shall also contain the specific goals and objectives to be obtained by implementation of the Plan including the protection and enhancement of the project’s scenic, recreational and other environmental values. In developing the Plan, the Contractor shall consider the best overall comprehensive use of the project shoreline including considerations for the project environment, aesthetics, recreational activities, historic resources and socio-economic impacts.
The below listed items shall be considered and incorporated as appropriate into the development of the Shoreline Management Plan for the Smith Mountain project.
5.1 Land Use
The Contractor shall be responsible for determining existing and proposing future land uses within the work area. The Contractor shall be responsible for obtaining all necessary data to make these determinations including: (1) reports available from Federal and State agencies, local governments, universities and other resources as appropriate; (2) zoning maps and regulations; (3) consultations with recognized planning organizations; (4) planning documents; and (5) other resources as appropriate. Actual land uses are to be documented by the Contractor in the field. The intent is to have the shoreline management plan compatible with established land use plans and zoning for the properties surrounding the project reservoirs. All lands owned by Appalachian Power Company within and immediately adjacent to the work area shall be identified by the Contractor. In addition, all properties donated or leased by Appalachian Power Company to private individuals, local governments, Federal and State agencies, and others for public recreational use shall be identified by the Contractor.
5.2 Recreational Resources
The Contractor shall utilize the Recreational Assessment prepared for Appalachian Power Company by Louis Berger Associates and dated December 1996 (copy attached) as the basis for determining the recreational uses for the Smith Mountain Pumped Storage Project during the term of the existing license for the Smith Mountain Project. The Contractor shall also obtain any and all information available including: (1) reports available from Federal and State agencies, local governments, universities and other resources as appropriate; (2) available planning documents; (3) consultations with recognized planning organizations; and (4) other resources as appropriate, to update the information from the Recreational Assessment. The Contractor shall document the existence of and the extent of recreational facilities within the work area by field reconnaissance. The extent of existing recreational facilities shall include an inventory of existing docks, piers, slips, access points, etc… The inventory should categorize the facilities as private, commercial, or public. In addition, public facilities providing access for those with special needs shall be inventoried. As a part of the Plan, the Contractor shall provide guidelines relative to providing access for those with special needs at public access locations. The information from the expanded Recreational Assessment prepared by the Contractor is to be utilized to determine where recreational development, both private and public, would be considered under the Shoreline Management Plan for the Smith Mountain Pumped Storage Project and the extent of that development to be considered within the project boundaries. As part of the Plan, the Contractor shall provide guidelines relative to the density of boat docks and slips to be considered within the project boundaries and along the project shorelines giving consideration to the classification of those facilities as private, commercial or public.
5.3 Shoreline Erosion
The Contractor shall make a field reconnaissance of the shorelines for both developments for the Smith Mountain Project to identify those areas requiring shoreline protection and to delineate the extent, types and effectiveness of existing shoreline protection measures. Utilizing that information along with existing shoreline protection requirements and generalized soil information for the work area available from local Soil and Water Conservation Districts and other appropriate resources, the Contractor shall develop an erosion control plan to be made part of the Shoreline Management Plan. The erosion plan shall be developed in consultation with the Steering Committee along with the Owner and address future erosion control measures to be considered under the Plan. As part of the Erosion Control Plan, the Contractor shall identify current dredging permit requirements and develop guidelines for future dredging and sedimentation management activities within the project boundaries.
5.4 Environmental and Natural Resources
Utilizing existing reports available from State and Federal agencies, local governments, universities and other resources as appropriate, the Contractor shall characterize the environmental and natural resources for the Smith Mountain Pumped Storage Project. The environmental and natural resources to be identified shall include but not be limited to: (1) wildlife; (2) fisheries; (3) water quality; (4) rare, threatened, and endangered species; (5) aquatic habitat; (6) wetlands; and (7) aesthetics. From the information obtained, visual field verifications, and consultations with the appropriate agencies, etc..., the Contractor shall identify sensitive areas which should be afforded protection under the Shoreline Management Plan. As part of the Plan, the Contractor shall also develop guidelines for the protection and enhancement of the environmental and natural resources within the boundaries of the Smith Mountain Pumped Storage Project.
5.5 Cultural Resources
The Contractor shall, utilizing existing reports and consulting with the Virginia State Historic Preservation Officer (SHPO), identify existing historic and archaeological resources within and in the vicinity of the work area. In addition, any and all interests of Native American groups shall be identified and addressed. From the information obtained, the Contractor shall identify areas which should be afforded protection under the Shoreline Management Plan and develop guidelines for the protection of cultural resources within the project boundaries.
5.6 Permitting
The Contractor shall prepare guidelines outlining the responsibilities of the Owner and the respective Federal and State agencies and local governments for implementing the Shoreline Management Plan. Those guidelines shall incorporate the existing permitting procedures as appropriate. However, the guidelines are not intended to supplant specific limitations, (i.e. electrical connections, dock widths and lengths, structural materials, etc.) established under existing permits, but should address items such as how to obtain necessary permits, the information required for certain types of permits, and the requirements for notifying the FERC of certain activities. The Contractor shall identify those activities requiring a permit or permission including but not limited to dock construction, shoreline stabilization, water withdrawals, roadway and bridge construction, utilities crossing the project boundaries, and others. The Contractor shall develop permitting procedures and application forms based upon existing forms for obtaining the appropriate permits and/or approval of activities that may take place within the project boundaries and/or work area. Special attention should be given to septic drainfield offset restrictions, the installation of heat exchange coils, and other potential future uses within the project boundaries. The Contractor should recognize that during development of the Plan he may be asked to provide input to the Steering Committee members and the Owner regarding the development of specific permit limitations to be established outside of those to be contained within the Plan.
5.7 Mapping
Utilizing existing available mapping from the Owner, Federal and State agencies, local governments, the United States Geological Survey (USGS), and/or other sources, the Contractor shall provide mapping in sufficient detail to delineate the limits of the various types of development, environmental areas to be protected, cultural resource areas to be protected and other components of the plan. As part of the plan, the Contractor shall also outline a strategy for developing detailed mapping necessary to implement other portions of the plan and to update the mapping in order to adequately implement the plan over time. Such a strategy should include consideration for Geographic Information System (GIS) applications.
5.8 Consultations and Public Meetings
The Contractor shall be responsible for providing representation, upon Owner’s request, at meetings with the Steering Committee, meetings with agencies and/or local government representative, meetings with non-governmental organizations, and at meetings with the Owner regarding the work. The Contractor shall also be responsible for the scheduling, coordination, and conducting public meetings necessary as part of development of the Plan. For the purposes of this document, up to four (4) public meetings should be considered.
6.0 WORK DATA
6.1 Work Schedule
The work schedule requires that the Smith Mountain Pumped Storage Project Shoreline Management Plan be filed with the FERC by June 30, 2003. Completion of the work by the Contractor shall be identified as the filing of the Plan by the Owner with the FERC and acceptance of the Plan by the FERC. For the purposes of this document, a preliminary project schedule as prepared by the Owner is attached.

6.4 Proposal Submittal
Submission of a proposal shall establish pima facie evidence that Contractor has read and accepts the terms and conditions of the specifications.

6.6 Exceptions to Specifications
The Bidder shall comply with all portions of this specification and attachments. The Bidder shall prepare a detailed listing of those items in its proposal which do not comply with this specification or attachments on the appropriate form provided as part of this Bid Inquiry Document and described herein. Unless specifically objected to with itemized exceptions, this specification, attachments and General Terms and Conditions shall supersede any inconsistent provisions of the Bidder’s proposal.
6.7 Modifications to Specifications
At any time prior to the bid deadline, a Bidder may request in writing to the party listed under Section 6.4 of the Bid Inquiry Documents to permanently withdraw, modify or resubmit its bid. The Bidder may undertake these actions only upon receiving approval from the Owner. In the event the proposal is withdrawn, the Bidder shall return all copies of the Bid Inquiry documents.
6.8 Clarifications
It is the responsibility of the Bidder that, before submitting his proposal, he fully understand the scope of work and that any ambiguities in these specifications, and/or supplemental information be brought to the Owner’s attention for clarification.
6.9 Award of Contract
The Owner will evaluate all proposals that conform to these Specifications. Award of contract shall be based upon price, quality, performance, appropriateness of proposal, and other parameters deemed at the Owner’s discretion to be in its best interest including input from the Steering Committee.
Owner reserves the right to reject any or all bid proposals submitted.
Owner reserves the right to have any or all Bidders present their proposals to the Steering Committee in person.
The Owner reserves the right to award all or part of the work based on Owner’s review of the bid proposals and further assessment as to the actual scope of work to be implemented.
The Owner will provide written notification to all Bidders once the successful Bidder has been selected.
6.10 Security
The area(s) where the work covered by these Bid Inquiry documents is to be carried out is not within the confines of the Owner’s security fencing. Upon examination of the site, if the Bidder believes additional measures are necessary to protect its equipment, labor, and work in progress, such additional security shall be provided by the Contractor and the related costs included in the bid prices. The Owner shall not assume any responsibility for damage to the Contractor’s property or the work in progress resulting from vandalism or from any other cause.
6.11 Safety
The Contractor should recognize that both the Smith Mountain Development and Leesville Development are active hydroelectric facilities and that the safety requirements of the Owner shall prevail and be practiced at all times by all parties involved in the work. The Owner shall have the discretion to have anyone not meeting the safety requirements of the Owner removed from the work site.
6.12 Floating Equipment
Any floating equipment such as boats, platforms, rafts, etc… brought into the work area by the Contractor or associated sub-contractor from outside of the project boundaries for the Smith Mountain Project shall be inspected for the existence of zebra mussels and subsequently cleaned to the satisfaction of the Owner prior to being placed into the waters associated with said project.
6.13 Intent
The nature and spirit of the Contract is to provide for the work described herein to be fully completed in every detail for the purpose designed, and it is hereby understood that the Contractor, in accepting the Contract, agrees to furnish anything and everything necessary for such purposes, not withstanding any omission in the Owner’s specifications and/or supplements to the specifications. Should the Contractor’s proposal conflict with the Owner’s specifications in any particular way, Owner’s specifications shall govern.
6.14 Pre-Bid Meeting
Owner initiated changes to the bidding documents may be presented during the pre-bid meeting.
6.15 Post-Bid Meeting
A post-bid meeting(s) may be held to review Contractor’s proposal and/or Scope of Work. Owner may elect to negotiate with Contractor to resolve any questions related to its proposal and to arrive at a final price. Revisions to bid amounts shall be justified and documented by Contractor. Owner will issue post-bid meeting minutes, which shall become a part of any future contract, which may be entered into for the work.
6.16 Commencement of Work
Contractor shall not perform work until the following conditions have been met:
a. Owner authorizes Contractor to start work.
b. A duly countersigned Contract has been received by Owner.
c. Contractor’s Certificate of Insurance has been received satisfying the insurance requirements of the terms and conditions.
